By using our website, requesting an estimate, booking services, signing any agreement, submitting payment, or otherwise engaging with the Company, you agree to these Terms.
1. Services
Rodriguez Painters, Inc. provides residential, commercial, and related services including, but not limited to:
- Interior painting
- Exterior painting
- Pressure washing
- Surface preparation
- Minor repairs (if agreed in writing)
- Other specialty services quoted by the Company
All services are subject to availability, inspection, scheduling, weather conditions, staffing, and final written approval.
2. Estimates & Quotes
All estimates, quotes, proposals, and pricing are:
- Based on information available at the time issued
- Subject to change if project scope changes
- Subject to correction of clerical or pricing errors
- Valid only for the period stated in writing, if any
Hidden damage, unforeseen conditions, code issues, structural issues, moisture, mold, rot, access limitations, customer-requested changes, or additional work may result in added charges.
3. Required Agreement / DocuSign Authorization
Before work begins, customers may be required to review and sign a separate project agreement, authorization form, proposal, or contract through DocuSign or another approved electronic signature platform.
Electronic signatures shall have the same force and effect as handwritten signatures to the fullest extent permitted by law.
Failure to sign required documents may delay scheduling or prevent commencement of work.
4. Deposits & Payment Terms
Unless otherwise stated in writing, the standard payment structure is:
- 50% initial deposit due before project start date or at commencement of work
- Remaining 50% balance due immediately upon substantial completion of the project
Materials, scheduling, labor reservation, administrative preparation, and project planning may begin once the deposit is received.
5. Cancellation / Deposit Refund Policy
If a customer cancels, postpones indefinitely, refuses scheduling, becomes unavailable, or chooses not to proceed after paying a deposit, the Company may retain 40% of the deposit amount to cover reserved labor time, planning, administrative costs, lost scheduling opportunities, estimates, and related expenses.
The remaining 60% of the deposit amount, if applicable, may be refunded within a commercially reasonable time.
If materials have already been purchased, custom ordered, tinted, delivered, or labor has already begun, additional deductions or non-refundable amounts may apply.
6. Final Payment / Completion
Final payment is due when the project is substantially complete, meaning the contracted scope has been materially performed, even if minor punch-list items, touch-ups, weather delays, or small corrective items remain.
Unreasonable withholding of final payment is prohibited.
7. Late Payments / Collections
Past-due balances may incur:
- Interest where permitted by law
- Collection costs
- Attorney's fees and court costs if enforcement is required
- Suspension of warranty obligations until paid in full
If a written project agreement specifically provides for liquidated damages or daily delay charges, such charges shall apply only to the extent enforceable under applicable law.
8. Important Notice on Daily Late Fees
Any fixed daily late fee (including amounts such as $500 per day) may be limited, reduced, or unenforceable under applicable law if deemed excessive, punitive, or not a reasonable estimate of actual damages. Rodriguez Painters, Inc. reserves the right to pursue all lawful remedies for nonpayment, including collections, interest, attorney's fees, and damages permitted by law.
